Terms and Conditions of sale.

Article 1: PRICE

1.1 Our products are priced in Euros (EUR) exclusive of tax (VAT is applied for Luxembourg at 15% for individuals and associations) and are exclusive of transport costs.

1.2 Deliveries made to all European Union member countries are also subject to VAT at the seller country’s current rate.

1.3 For the purposes of a delivery to a country other than Luxembourg or a European Union member country, you are the importer of the relevant product(s). Customs taxes or other local taxes or import taxes or state-level taxes may be charged. These charges and fees are not the responsibility of Lyon Apparel. They are your full responsibility and to be met at your expense in accordance with the payment declarations required by the relevant authorities and organisations in your country. You are advised to familiarise yourself with the relevant requirements by consulting the relevant local authority.

1.4 Lyon Apparel reserves the right to alter its prices at any time, though products are invoiced based on the tariffs that are current at the time of the order being recorded.

1.5 The products remain the property of Lyon Apparel until full payment has been made.

Article 2: ORDERING

Orders can be placed as follows:

An itemised invoice will be sent to you be email. Lyon Apparel reserves the right to cancel or refuse to fill an order from a client where there is a dispute over payment in relation to a previous order.

Article 3: ACCEPTANCE

When you place an order, you are also confirming that you have familiarised yourself with and accepted these Terms and Conditions of Sale. Confirmation of your order therefore means you have accepted these Terms and Conditions of Sale.

Article 4: AVAILABILITY

The products and prices shown by us are valid while they are shown on the site and are subject to the availability of the stock.

Article 5: DELIVERY

We deliver throughout Europe.

Products are sent to the delivery address given when the order is placed. The average waiting time for customised items is 4 to 6 weeks, and delivery is usually made in 5 to 10 working days. An email will be sent to you in the event of a delay in the items being sent.

Article 6: PAYMENT

Payment for the items you have bought is to be made as follows:

  • By bank transfer using the following details:

  • By Paypal (transfer or Bank Card) to our account paypal@noux.lu

Confirmation of your order takes place when the whole payment is settled.

Article 7: PRODUCT CONFORMITY

We undertake to provide a refund for or exchange any product that appears to be defective, spoiled or damaged, or any product that does not conform to your order. Should this situation arise, you are kindly requested to provide a detailed written account of the situation and to send us the product(s). Lyon Apparel will refund or exchange the product(s) in accordance with your wishes. Any such request must be made within seven (7) working days of delivery. Any claim made after this time cannot be accepted.

Forwarding charges will be refunded based on the price as billed and the cost of returning the product(s) will be refunded. In any event, you are covered by the provisions of legally required guarantees, in particular those that relate to warranties against hidden defects.

Article 8: REFUNDS

Refunds for products due in the scenario set out in Article 7 will be made within a period not exceeding fifteen (15) days after the products have been received by us.

Refunds are made to your bank account. Cash on delivery arrangements will not be accepted under any circumstances.

Article 10: LIABILITY

The products that are made available are in conformity with current European legislation. In the event that the country to which products are delivered does not abide by European legislation then Lyon Apparel is not liable. It is your responsibility to check with the relevant local authorities what the situation is regarding the import and use of the products you are intending to order.

Photographs and models provided are for illustration purposes only. You are invited to consult the description of each product in order to familiarise yourself with their exact specifications. Please do not hesitate to contact us if you have any questions, or if you need further information.

Article 11: RIGHTS

The items on the www.lyon-apparel.com and the documents bearing the Lyon Apparel, including texts, illustrations and photographs, may not be used, modified, altered or reproduced either partially or totally, and in any case no use is to be made of these whatsoever without the explicit agreement of the company Lyon Apparel.

On the other hand, Lyon Apparel is considered allowed to display all articles bearing the Lyon Apparel on its web site.

Article 12: LEGAL JURISDICTION IN A DISPUTE

This contract is subject to the law of Luxembourg. This contract is originally drawn up in the French language. Any dispute to be dealt with falls exclusively within the jurisdiction of the Commercial Court of the Grand Duchy of Luxembourg (“Tribunal de Commerce du Grand-Duché du Luxembourg”) which is the only authority with the competence to rule over it, regardless of where the product(s) are sent to.

Article 13: PERSONAL DATA

We need information and data about you to manage your order and to manage our business relationship. This information and data is retained for security purposes in order to adhere to our legal and regulatory obligations as well as to improve and customise the services we provide and the information we direct towards you.

In accordance with the European directive 95/46/CE dated 24th October 1995, you have the right to access and correct personal data that is held about you. All you need to do is to write to us by email at info@lyon-apparel.com or by letter to: Lyon Apparel – Rue de l’Industrie / Coin des Artisans – 3895 Foetz – Luxembourg, giving us your first name and surname and your email address.
